class="Apple-converted-space"> </span> Dit verslag gestuurd is naar het e-mailadres<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> a) het opleggen van een sanctie;<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> b) de gronden om een sanctie op te leggen;<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> c) de duur van deze sanctie;<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> niet zijn genomen door middel van hoofdelijke stemming in een<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> bestuursvergadering.<br><br><br><br>Hierbij in acht nemend dat:<br><br>I<span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> Er geen beroepscommissie bestaat, hoewel dit een statutaire vereiste<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> is om sancties op te leggen;<br>II<span class="Apple-converted-space"> </span> Samir Allioui aangesteld is in zijn door een ALV en in geen geval<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> een bestuur een besluit of aanstelling van een ALV mag overwerpen<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> zonder expliciete goedkeuring van de Ledenraad;<br>III<span class="Apple-converted-space"> </span> De motie[1] om internationale coördinatoren onder aanstelling van<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> een ALV te plaatsen aangenomen is bij de ALV die heeft<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> plaatsgenomen op 25 november 2012;<br>IV<span class="Apple-converted-space"> </span> De vice-voorzitter die als één van de vertegenwoordigers van het<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> bestuur fungeert in dit schrijven expliciet heeft aangegeven[2]<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> middels een officiëel communicatiekanaal dat dit besluit tot doel<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> heeft Samir Allioui geen stem te bieden bij de General Assembly<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> van de Pirate Parties International, welke plaats vindt in minder<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> dan 24 uur na dit schrijven en dat de reden hiervoor een politieke<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> is - hoewel de politieke verantwoordelijkheid bij de Ledenraad<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> ligt en niet het partijbestuur;<br>V<span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> Het bestuur zelf haar taken heeft verzaakt in het opstellen van een<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> richtlijn voor internationale coördinatie in samenwerking met de<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> Ledenraad, hoewel dit een vereiste is per een aangenomen motie op<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> de ALV van 25 november 2013 en hierdoor Samir Allioui ook niet<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> verantwoordelijk kan houden voor het niet volgen van richtlijnen<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> die tot op heden niet zijn opgesteld;<br>VI<span class="Apple-converted-space"> </span> Samir Allioui initiatief heeft getoond door zijn gedrag na eerdere<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> mailwisseling aan te passen en door een verslag te sturen, en dat<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> het verslag niet formeel is besproken in een bestuursvergadering<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> - enkel de vice-voorzitter heeft zich uitgesproken tegen het<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> verslag buiten een bestuursvergadering met enkel arbitraire, niet-<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> onderbouwde en subjectieve kritiek;<br>VII<span class="Apple-converted-space"> </span> De vice-voorzitter hierin mogelijk een persoonlijk belang heeft,<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> gezien zijn zelfaanstelling als 'internationaal coördinator'[3]<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> ondanks de eerder in III aangenomen motie van de ALV welke bepaalt<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> dat enkel de ALV zich mag uitspreken over de aanstelling van<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> internationaal coördinatoren;<br>VIII Er geen procedure, danwel Huishoudelijk Reglement, bestaat rondom<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> het opleggen van sancties, beroepsmogelijkheid en criterium van<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> welk orgaan een sanctie oplegt danwel welk stempercentage vereist<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> is om een dergelijke sanctie goed te keuren;<br>IX<span class="Apple-converted-space"> </span> Er op dit moment geen vervangende representatie danwel<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> internationaal coördinator beschikbaar is;<br>X<span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> Het bestuur mogelijk niet over voldoende en actuele kennis beschikt<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> omtrent internationale gebeurtenissen - gebaseerd op persoonlijke<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> ervaringen uit bestuursvergaderingen;<br>XI<span class="Apple-converted-space"> </span> Gebruikelijk is binnen organisaties dat in geval van een dergelijke<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> sanctie, deze in werking treedt 14 dagen na dagtekening om een<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> correcte overdracht te bewerkstelligen - tenzij sprake is van een<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> zeer spoedeisende reden, welke redelijkerwijs hier geen sprake<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> van is.<br>XII<span class="Apple-converted-space"> </span> Ondergetekende, partijsecretaris, expliciet heeft aangegeven geen<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> partij te zijn in eerdere besprekingen in verband met een<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> redelijk belang tot neutraliteit.<br><br><br><br>De secretaris, en daarmee het secretariaat, concludeert dat:<br><br>I<span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> Dit besluit niet rechtsgeldig is;<br>II<span class="Apple-converted-space"> </span> Zowel Samir Allioui als Rodger van Doorn derhalve op heden volledig<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> hun functie als soevereine internationaal coördinatoren kunnen<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> blijven uitoefenen;<br>III<span class="Apple-converted-space"> </span> Zij, indien verzocht, een bevestiging zal sturen naar<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> vertegenwoordigers van Pirate Parties International met<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> bovenstaande conclusie en de melding dat zowel Samir Allioui als<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> Rodger van Doorn volledig in functie zijn.<br><br><br><br>Daarnaast adviseert de secretaris, en daarmee het secretariaat naar de<br>Ledenraad:<br><br>I<span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> Een onderzoek uit te voeren naar dit besluit, gezien haar taak als<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> controlerend orgaan;<br>II<span class="Apple-converted-space"> </span> Een onderzoek uit te voeren naar de neutraliteit van de individuele<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> bestuurders in deze zaak met betrekking tot de persoon,<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> ondergetekende incluis;<br>III<span class="Apple-converted-space"> </span> Een onderzoek uit te voeren naar mogelijke belangenverstrengeling<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> van de bestuurders met betrekking tot de functie van<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> internationaal coördinator, ondergetekende incluis;<br>IV<span class="Apple-converted-space"> </span> Een onderzoek uit te voeren naar het gebrek van een<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> a) Huishoudelijk Reglement;<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> b) Procedure voor Internationale Coördinatie;<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> daar deze vereist zijn per aangenomen moties bij de ALV van 25<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> november 2012;<br>V<span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> De aanstellen van een beroepscommissie zo spoedig mogelijk te<br><span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> <span class="Apple-converted-space"> </span> voltooien.<br><br><br><br>Indien verzocht zullen uiteraard alle relevante notulen, opnames,<br>e-mails, logs en andere communicatieoverzichten ter beschikking
